Terms of Use
Last updated: November 1, 2026
These terms apply to the use of the Walnut iOS app. The provider is Vincent Tietze. The full address is in the Impressum (legal notice). Contact: quizel.support@protonmail.com. If this English version and the German version differ, the German version prevails.
1. Scope
These terms apply to your use of Walnut in addition to Apple's Standard End User License Agreement and the App Store terms. Where Apple's mandatory terms provide otherwise, they take precedence.
2. What Walnut does
Walnut uses AI to turn speech into events, reminders and notes, can restructure notes by voice and, if you like, writes a short briefing for the day. The exact scope follows from the current app version and its App Store description.
3. Check AI results
AI can misunderstand speech. Walnut may therefore create, change or delete entries with the wrong content, date or time, restructure notes differently than intended, and summarise things incompletely or wrongly in the briefing. Check the entries and changes Walnut shows you after you speak.
Walnut is a tool for personal organisation. For important or time-critical matters, such as medication, deadlines or appointments with legal or financial consequences, do not rely on Walnut alone. Whether notifications appear on time also depends on iOS, your device settings and the network.
4. Your content
Your entries belong to you. You allow us to process them only as far as needed for the features you use, security and operation. Details are in the Privacy Policy. Do not enter content you may not use or send to AI services.
5. Free use, subscription and limits
Walnut is free to download. Some features require a subscription ("Walnut Pro") or are free only to a certain extent. The app shows what is included before you buy.
You buy subscriptions through the App Store. Apple shows the price, term and any free trial before purchase. Apple decides whether you are eligible for a trial. The subscription renews automatically for the chosen term unless you cancel at least 24 hours before the end of the trial or the billing period. Payment is charged to your Apple Account. You cancel and manage the subscription in your Apple Account settings. Deleting the app does not cancel it. Apple handles refunds.
Reasonable technical limits apply even with a subscription, such as a maximum number of requests per day, to protect the service from abuse and overload. Normal personal use does not reach them. After a subscription ends, your entries remain and stay readable.
Mandatory statutory rights, in particular warranty, withdrawal and consumer rights, remain unaffected.
6. Acceptable use
Use Walnut only for lawful purposes. You may not attack or overload the app or our server, query it automatically, reverse engineer it except where the law permits, or circumvent security, purchase or usage limits. If abuse is reasonably suspected, we may restrict the affected installation's access to our server.
7. Availability and changes
The AI features need an internet connection and third-party services. They may be temporarily unavailable, for example due to maintenance, provider outages or network problems. We keep developing Walnut and may change the app where there is a valid reason, such as technical progress, changes to our providers' services, security or changes in the law. Changes during an ongoing subscription are subject to the statutory requirements, in particular Section 327r of the German Civil Code (BGB).
8. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and to the extent of any guarantee given.
For slight negligence we are only liable for breach of an essential contractual obligation, meaning an obligation whose fulfilment makes proper performance of the contract possible in the first place and on whose fulfilment you may regularly rely. In that case, liability is limited to the foreseeable damage typical for the contract. Otherwise liability for slight negligence is excluded.
9. Termination
You can stop using Walnut and delete the app at any time. You cancel an ongoing subscription through your Apple Account. In the event of a material breach of these terms, we may end the affected installation's access to our server.
10. Changes to these terms
We may change these terms for the future if the app, legal requirements or our service providers' terms change. Changes that affect an ongoing subscription to your disadvantage only apply with your consent.
11. Law and dispute resolution
German law applies. If you are a consumer, you keep the protection of the mandatory provisions of the country where you habitually reside. We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
If any provision is invalid, the rest remain valid.
